Does a State-Legal Psilocybin Program Protect You From Federal Prosecution?
By Microdosing College Editorial·Last updated May 9, 2026·8 min read
Is psilocybin federally illegal in legal states? Yes — unambiguously. No matter what Oregon Measure 109, Colorado Proposition 122, or New Mexico's therapeutic-use framework says, the federal Controlled Substances Act (CSA) of 1970 classifies psilocybin and psilocin as Schedule I substances, and that classification has never changed. Participating in a state-licensed psilocybin session does not immunise you — or the facilitator, the service centre, or the grower — from potential federal prosecution.
This article explains the legal architecture that creates this gap, what has kept federal prosecutors from acting so far, and what the realistic risk landscape looks like for participants today. For the broader picture of how psilocybin is regulated around the world, see our pillar guide on microdosing laws by country.
The Supremacy Clause: Why Federal Law Always Wins
The U.S. Constitution's Supremacy Clause (Article VI, Clause 2) establishes that federal law is "the supreme Law of the Land" and that state laws in direct conflict with it are invalid. The Supreme Court applied this principle to drug policy in Gonzales v. Raich, 545 U.S. 1 (2005), ruling that Congress can regulate even locally grown cannabis under its commerce power — a holding that effectively authorised federal enforcement in cannabis-legal states and that courts have since relied on in parallel drug contexts.
The result for psilocybin is structural: a state cannot grant a legal right that federal law criminally prohibits. Oregon's Measure 109 created a licensed psilocybin services framework; it did not, and legally could not, reschedule psilocybin at the federal level. The same is true of Colorado's Natural Medicine Health Act (Proposition 122, passed November 2022) and the limited therapeutic-use pathway that New Mexico operates under.
This is not a technicality. A person who completes a facilitated psilocybin session in a licensed Oregon service centre has, under federal law, possessed a Schedule I controlled substance — a crime punishable by up to one year imprisonment for simple possession and substantially more for any distribution-adjacent conduct.
What Schedule I Actually Means
Under 21 U.S.C. § 812 of the Controlled Substances Act, a Schedule I substance is defined as having a high potential for abuse, no currently accepted medical use in treatment in the United States, and a lack of accepted safety for use under medical supervision. The DEA placed psilocybin and psilocin on Schedule I when the CSA came into force in 1970, and neither the DEA nor Congress has moved them since.
Critically, "no currently accepted medical use" is a federal determination — it does not track FDA Breakthrough Therapy designations (psilocybin received two, for treatment-resistant depression and major depressive disorder), state legislation, or scientific consensus. Scheduling changes require a formal DEA rulemaking process, which has not occurred despite multiple petitions.
For a deeper look at the scheduling history and what it would take to change it, see our companion piece on psilocybin Schedule I explained.
What Oregon, Colorado and New Mexico Actually Permit
Each of the three state frameworks was designed with the federal conflict in mind, and each creates state-law safe harbours — not federal ones.
Oregon Psilocybin Services (ORS Chapter 475A) became operative in January 2023. It permits licensed manufacturers, testing labs, service centres, and facilitators to produce, transport, and administer psilocybin to adult clients in supervised sessions. Clients consume psilocybin on licensed premises rather than possessing it at home, which reduces some state-law exposure — but the federal CSA does not make that distinction. Our full breakdown of Oregon Psilocybin Services covers the state rules in detail.
Colorado's Natural Medicine Health Act (Proposition 122), phasing in from 2024, permits licensed healing centres, cultivators, and manufacturers. It also includes a personal cultivation and sharing allowance for adults 21 and over — all of which remain federal offences under the CSA. Details are in our Colorado Natural Medicine Act explainer.
New Mexico has a longer history: its Court of Appeals ruled in State v. Barela (2005) that growing psilocybin mushrooms for personal use did not constitute "manufacturing" under state law, creating a grey zone rather than an affirmative legalisation. No Oregon-style licensed commercial programme exists in New Mexico, and state-level non-prosecution leaves federal exposure entirely intact.
All three frameworks share one feature: they were designed by state actors who have no authority over federal enforcement priorities.
Federal Enforcement in Practice: Rare but Real
The honest answer to "will the federal government prosecute me for attending a licensed Oregon session?" is: probably not as of mid-2026, but the risk is not zero and has never been formally waived.
The Department of Justice has used prosecutorial discretion memos before — the 2013 Cole Memorandum deprioritised federal cannabis enforcement against individuals complying with robust state regimes. That memo was rescinded in January 2018, was never law, and set no precedent that courts are bound to follow. No equivalent memo exists for psilocybin, and neither the Biden nor subsequent administrations have issued one.
In practice, several categories of participants face meaningfully elevated federal exposure compared with individual session clients:
Facilitators and business operators handle commercial quantities and maintain records, making them more visible targets than individual clients.
People on federal property — national parks, federal buildings, military bases — fall under exclusive federal jurisdiction regardless of state law.
People with prior federal drug convictions may face mandatory minimum enhancements.
Interstate transport — carrying psilocybin across state lines, even between two "legal" states, is a federal trafficking offence.
Federal employees and security-clearance holders face employment and clearance consequences from Schedule I substance use regardless of state law.
The failure of Massachusetts Question 4 in November 2024 — a broader psychedelics decriminalisation initiative defeated by voters — illustrates that political conditions for a DOJ deprioritisation memo are not yet in place. Ballotpedia's record of the initiative (Ballotpedia, Massachusetts Question 4, 2024) and STAT News's post-election analysis (STAT News, November 6, 2024) both document the scale of the defeat and what it signals for reform momentum. For more on why state ballot measures have struggled, see our article on why psilocybin ballot measures fail.
Practical Implications for Prospective Participants
For anyone evaluating a state-licensed psilocybin experience, the legal exposure is real even when enforcement is currently low. Several specific risk areas deserve attention:
Federal employment and security clearances. Federal employees and contractors may face adverse employment action from any disclosed Schedule I substance use. Clearance adjudicators apply federal drug-use standards, not state law. The state-legal character of the use is not a mitigating factor under current federal guidelines.
Professional licensing. Some state-level licensing boards — medical, legal, financial services — require disclosure of drug use and may apply standards that do not defer to state legalisation frameworks. The implications vary by profession and jurisdiction.
Immigration. Non-citizens face particular risk; federal drug offences carry immigration consequences that can include deportation or bars on naturalisation, and state legalisation does not protect against them.
Borders and post. Receiving psilocybin across state or national borders creates federal trafficking exposure. This applies to domestic mail as much as international shipments — a risk our article on ordering truffles by post: import legal risk addresses in detail.
Health and personal suitability. Legal access does not mean the experience is appropriate for everyone. Certain medical conditions, psychiatric histories, and medication combinations can make psilocybin sessions significantly risky regardless of their legal status. Before any decision, use our self-screener and discuss your circumstances with a qualified clinician.
The gap between state permission and federal prohibition is a structural feature of U.S. drug policy, not a temporary oversight. It will persist until Congress reschedules psilocybin or removes it from the CSA entirely — a step that, as of mid-2026, has not been taken.
Frequently asked
Is psilocybin federally illegal even in states where it is legal?+
Yes. Psilocybin remains a Schedule I controlled substance under the federal Controlled Substances Act (21 U.S.C. § 812) regardless of what Oregon, Colorado, or New Mexico permit. State laws can only create state-law safe harbours against state prosecution; they cannot override federal law.
Can the federal government prosecute someone for using psilocybin at a licensed Oregon service centre?+
Legally, yes. The Supremacy Clause and Gonzales v. Raich (2005) confirm that federal drug law overrides state permission. No documented federal prosecutions of licensed-session participants have occurred as of mid-2026, but no formal non-enforcement policy exists for psilocybin either.
Does the FDA's Breakthrough Therapy Designation change psilocybin's Schedule I status?+
No. Breakthrough Therapy Designation accelerates FDA review of clinical trials but does not alter DEA scheduling. Only a formal DEA rulemaking or an Act of Congress can move psilocybin off Schedule I.
Is transporting psilocybin across state lines a federal crime even between two legal states?+
Yes. Interstate transport of a Schedule I controlled substance is a federal trafficking offence under the CSA regardless of the laws in the origin or destination state. The federal offence is committed at the point of transport.
Do federal employees or security-clearance holders face additional risks from state-legal psilocybin use?+
Yes. Federal employment law and security-clearance adjudications treat Schedule I substance use as grounds for adverse action independent of state law. Oregon or Colorado's legal frameworks do not override federal employment or clearance standards.
