Decriminalisation vs Legalisation vs Regulation: What the Words Actually Mean for Psilocybin
By Microdosing College Editorial·Last updated May 26, 2026·8 min read
The phrase decriminalisation vs legalisation psilocybin appears constantly in headlines, but the two words describe very different legal realities — and a third term, regulation, is often missing from the conversation entirely. Getting these definitions right is not pedantry: a person who moves from a city that has 'decriminalised' mushrooms to a state where they remain fully illegal can be prosecuted, because deprioritising arrests is not the same as removing criminal liability. This article defines each term precisely, shows how it plays out in real jurisdictions, and explains why the gap between policy language and lived access is often much wider than advocates imply.
For the broader picture of where psilocybin sits in the law around the world, see our pillar guide on .
Before any national or local policy can be understood, there is an international floor. The Convention on Psychotropic Substances of 1971, administered by the UN International Narcotics Control Board (INCB), places psilocybine and psilocine in Schedule I — the most restrictive category, reserved for substances deemed to have high abuse potential and no accepted medical use at the time of the treaty (INCB, 1971). Every signatory state — including the United States, the United Kingdom, the Netherlands, Germany, and most others — is bound by this framework. No city or county ordinance can override a federal or national law that itself rests on a treaty obligation.
This is why decriminalisation, even when genuine, has hard limits: it operates inside a national prohibition that is itself nested inside an international one.
What decriminalisation actually means
Decriminalisation removes or reduces the criminal penalties attached to possession or personal use of a substance — typically replacing arrest and prosecution with a civil fine, mandatory referral to a treatment programme, or no formal penalty at all. It does not make the substance legal to produce, sell, or distribute. The supply chain remains a criminal matter.
Portugal's 2001 drug law is the most-cited example. It decriminalised personal possession of all drugs (above a defined threshold), resulting in reduced incarceration and improved public-health outcomes — but drug trafficking in Portugal remained and remains a criminal offence. A visitor who buys mushrooms in Lisbon from a dealer is interacting with a criminal supply chain regardless of what happens if police find a small quantity in their pocket.
In the United States, several cities — Denver (2019), Washington D.C. (2020), Seattle (2021), and others — passed initiatives instructing police to make enforcement of psilocybin laws their lowest priority. This is sometimes called deprioritisation, and it is even weaker than formal decriminalisation: it is an administrative direction to law enforcement, not a change in the law. Psilocybin remained a Schedule I controlled substance under the federal Controlled Substances Act in all of these jurisdictions the morning after each vote. If a federal agent, not a city police officer, encounters the same person with the same mushrooms, the city's ordinance is simply irrelevant.
California's Senate Bill 58 — which would have decriminalised personal possession of psilocybin statewide — was vetoed by Governor Newsom in October 2023. His veto message called explicitly for treatment guidelines to be established before any change to criminal penalties, illustrating that decriminalisation is a contested policy choice even among jurisdictions broadly sympathetic to reform (Governor of California, SB 58 Veto, 2023).
For a closer look at how this plays out across US cities, see our article on psilocybin spores and the legal grey area, which illustrates just how precisely drawn these distinctions are at the federal level.
What legalisation means — and what it does not guarantee
Legalisation removes a substance from the list of prohibited things: possession, use, and often transfer become lawful acts. But legalisation alone does not create a market. Cannabis legalisation in several US states has demonstrated this clearly: after a state votes to legalise, years of rulemaking, licensing, and regulatory work are typically needed before a consumer can legally walk into a shop. And where federal prohibition remains — as it does for cannabis in the US — legal state markets coexist with continued federal risk.
No jurisdiction has fully legalised psilocybin mushrooms in the sense of making unrestricted civilian possession and commerce lawful. The closest approximations are jurisdictions that have effectively decriminalised through non-enforcement, or that have created tightly bounded legal frameworks for specific uses — which brings us to regulation.
What regulation means: the spectrum from medical to adult-use
Regulation is the legal architecture that governs how a substance can be produced, sold, and consumed once some form of legal access has been permitted. It sits above legalisation in practical complexity and is the stage most jurisdictions with recent psilocybin reforms are actually at.
Regulatory frameworks for psilocybin currently come in two main shapes:
Medical / supervised-access models — A handful of jurisdictions have created pathways where psilocybin can be administered under clinical supervision, without necessarily changing its status for recreational or personal use. Oregon's Measure 109, which created a licensed psilocybin services framework (not a medical programme per se, but a supervised-use model), is one example. Australia's Therapeutic Goods Administration rescheduled psilocybin to Schedule 8 in July 2023, enabling authorised psychiatrists to prescribe it to patients under specific conditions — not a general legalisation, but a narrow therapeutic gateway (TGA, 2023). Switzerland operates a similar limited medical use programme under its Narcotics Law, with approximately 723 patients authorised for psilocybin-assisted therapy in 2024 alone (Aicher, Mueller, Gasser et al., Neuroscience Applied, 2025).
Personal-use regulated models — These are rarer and more recent. They attempt to define a legal space for adult personal use without requiring a clinical or therapeutic justification. Oregon's framework again straddles this line: it licenses facilitators and service centres rather than retail sales.
In the Netherlands, psilocybin mushrooms have been banned under the Opium Act since December 2008, but psilocybin truffles (the underground sclerotia of the same fungi) were never added to the controlled substance list and can be legally sold. This is neither decriminalisation nor legalisation in the strict sense — it is a legislative gap that creates a de facto legal retail market for truffles while mushrooms above ground remain prohibited. The European Union Drugs Agency (EUDA) notes the heterogeneity of national controls on hallucinogenic mushrooms across EU member states, precisely because this kind of definitional line-drawing creates different practical realities in different countries. For a detailed explanation of this distinction, see are psilocybin truffles legal — explained.
Why the gap between policy and access matters
The practical consequences of confusing these terms are significant.
A resident of Denver, where psilocybin enforcement was deprioritised, still cannot legally buy mushrooms anywhere in Colorado's regulated recreational market (that framework does not cover retail mushroom sales). They cannot legally grow mushrooms without risking federal charges. The deprioritisation initiative reduced the practical risk of personal possession arrests by city police — it did nothing else.
Similarly, a patient in Australia who wants psilocybin-assisted therapy cannot simply request it: they must find an authorised psychiatrist, qualify under the scheme's clinical criteria, and use a TGA-approved product. The regulatory framework is real, but the access it creates is narrow.
Understanding this spectrum — deprioritisation, decriminalisation, legalisation, regulation — is also relevant to personal safety decisions. If you are considering whether microdosing is viable in your jurisdiction, the legal category of your location matters enormously. The table illustrates a critical point: legalisation without regulation creates permission but not access; regulation without full legalisation creates access but only inside a defined box.
What this means if you are reading from outside a permissive jurisdiction
Most people reading about psilocybin policy live in places where none of the above applies — where mushrooms are controlled, no exemptions exist, and local enforcement has not been deprioritised. For those readers, the distinction between terms is not primarily about what they can do today but about how to read the news accurately.
When a headline says a city has 'legalised mushrooms,' check whether the ordinance actually changed criminal law or merely directed police to stop making arrests. When an article says a country has 'opened up psilocybin access,' check whether that access is available to ordinary adults or only to patients within a heavily supervised medical protocol.
The international treaty baseline described at the start of this article has not changed. The 1971 Convention on Psychotropic Substances remains in force, and each reform in each jurisdiction is an exception carved out of that structure — not a sign that the structure is dissolving.
For jurisdiction-specific details, our microdosing laws by country hub collects the picture country by country, and the psilocybin spore legal grey area article examines one of the most counter-intuitive sub-distinctions within US federal law. Frequently asked
What is the difference between decriminalisation and legalisation of psilocybin?+
Decriminalisation removes or reduces criminal penalties for personal possession but leaves the supply chain illegal — you can't be arrested for small amounts, but there is no legal way to buy or sell mushrooms. Legalisation removes prohibition outright, though it doesn't automatically create a regulated market. Most cities that have 'decriminalised' psilocybin have actually only deprioritised enforcement, which is even weaker.
If a city has deprioritised psilocybin enforcement, can I legally buy mushrooms there?+
No. Deprioritisation tells local police to make psilocybin their lowest enforcement priority; it doesn't change the underlying law. The supply chain remains criminal, and federal law — which is unaffected by city ordinances — still classifies psilocybin as a Schedule I controlled substance.
Does the 1971 UN Convention mean no country can ever legalise psilocybin?+
The Convention on Psychotropic Substances of 1971 places psilocybine and psilocine in Schedule I, which obligates signatory states to prohibit non-medical use. Countries can create narrow exceptions for medical or scientific use within that framework, and a state can theoretically withdraw from the treaty — but no country has done so for psilocybin. This is why all current reforms are exceptions rather than outright legalisation.
Are psilocybin truffles legal in the Netherlands because the country 'decriminalised' them?+
Not exactly. The Netherlands banned psilocybin mushrooms under the Opium Act in 2008, but truffles (sclerotia) were never added to the controlled list — creating a legislative gap rather than a deliberate decriminalisation policy. Truffles can be legally sold; mushrooms above ground cannot. This is a definitional boundary, not a policy of tolerance.
What does a regulated psilocybin framework look like in practice?+
Examples include Australia's Authorised Prescriber scheme (psychiatrists can prescribe to qualifying patients under TGA oversight), Switzerland's limited medical use programme (federal authorisation required per patient), and Oregon's Measure 109 services model (licensed facilitators and service centres, not retail sales). In each case, legal access is real but narrow — not a general right to purchase or possess freely.
